中砂與前主導研發宋健民之專利訴訟

事:專利訴訟,日前經美國德拉瓦州法院裁定暫停訴訟程序,將等台灣智財法院針對專利權歸屬做出判決後再審理。

德拉瓦州法院於美國時間19日根據中砂的主張,裁定停止上開訴訟程序。待台灣智慧財產法院就相關專利權利歸屬做成判決,一旦獲智慧財產法院勝訴判決確定,即可證明宋健民向德拉瓦州法院提起的專利侵權訴訟並無理由,美國法院即毋須進行實質審理。

Upon information and belief, each Defendant has and continues to directly infringe one or more claims of the ’699 patent under 35 U.S.C. § 271 by making, using, selling, offering to sell, importing and/or providing and causing to be used products that are used to polish semiconductor wafers, which products by way of example include semi-conductor Chemical Mechanical Planarization (CMP) tools such as the CMP Diamond disk (the “Accused Instrumentalities”).
Upon information and belief, Kinik has knowledge of the ’699 patent and has induced and continues to induce others to infringe at least one claim of the ’699 patent under 35 U.S.C. § 271(b) by, among other things, and with specific intent or willful blindness, actively aiding and abetting others to infringe, including but not limited to Kinik’s partners and customers, whose use of the Accused Instrumentalities constitutes direct infringement of at least one claim of the ’699 patent.
In particular, Kinik’s actions that aid and abet others such as their partners and customers to infringe include advertising and distributing the Accused Instrumentalities and Case 1:14-cv-01027-UNA Document 1 Filed 08/08/14 Page 3 of 5 PageID #: 3 Page 4 of 5 providing instruction materials, training, and services regarding the Accused Instrumentalities. On information and belief, Kinik has engaged in such actions with specific intent to cause infringement or with willful blindness to the resulting infringement because Kinik has had actual knowledge of the ’699 patent and knowledge that its acts were inducing infringement of the ’699 patent since at least the date Kinik acquired such knowledge.
Upon information and belief, Kinik is liable as a contributory infringer of the ’699 patent under 35 U.S.C. § 271(c) by offering to sell, selling and importing into the United States semiconductor wafers polishing tools to be especially made or adapted for use in an infringement of the ’699 patent. The Accused Instrumentalities are material components for use in practicing the ’699 patent and are specifically made and are not a staple article of commerce suitable for substantial non-infringing use.

Publicly available materials advertising the Surfing Electric Scooter are attached hereto as Exhibit C.

Defendant Changzhou has announced its intention to exhibit and offer for sale the infringing “Surfing Electric Scooter” product at the 2016 International CES show to be held January 6-9 in Las Vegas, Nevada. Attached as Exhibit D hereto is a copy of an advertising flyer distributed by Changzhou in advance of the CES show.

IBM 23年蟬聯在美取得最多專利數量

根據專利資料庫公司IFI Claims公布的最新統計,去年美國專利商標局(USPTO)一共核發29.8萬項功能性專利,較前年數量減少1%,是2007年以來首度下滑。除了IBM之外,2015年前10大排名的企業包括三星電子、佳能、高通、谷歌、樂金電子(LG)及英特爾。但微軟名次下滑至第10名,因微軟去年功能性專利數量減少31%。其中,IFI Claims資深分析師凱帝(Larry Cady)表示:「與其將所有專利歸在同一個立案公司旗下,近來有不少企業選擇將專利分散到多個獨立公司,這也是微軟及Panasonic去年專利數量大幅減少的主因。」蘋果去年名次維持在第11名,而亞馬遜科技名次從前年的第50名躍升至去年的第26名。

A system and method for reducing service latency includes dividing an information technology service for a customer into an infrastructure management service and a data management service. Data associated with the information technology service is stored in a backup memory. A set of infrastructure images related to the information technology service is stored at a cloud service provider. The infrastructure images are updated with software updates and hardware updates, as needed, and the data associated with the information technology service is updated through backup and restore mechanisms. The set of infrastructure images that have been updated with data with latest updates are started for recovery, continuity, testing, etc.

Form and content of claims

(1) The claims shall define the matter for which protection is sought in terms of the technical features of the invention. Wherever appropriate, claims shall contain: 
(a) a statement indicating the designation of the subject-matter of the invention and those technical features which are necessary for the definition of the claimed subject-matter but which, in combination, form part of the prior art; 
(b) a characterising portion, beginning with the expression "characterised in that" or "characterised by" and specifying the technical features for which, in combination with the features stated under sub-paragraph (a), protection is sought.
(2) Without prejudice to Article 82, a European patent application may contain more than one independent claim in the same category (product, process, apparatus or use) only if the subject-matter of the application involves one of the following:
(a) a plurality of interrelated products, 
(b) different uses of a product or apparatus, 
(c) alternative solutions to a particular problem, where it is inappropriate to cover these alternatives by a single claim. 
(3) Any claim stating the essential features of an invention may be followed by one or more claims concerning particular embodiments of that invention. 
(4) Any claim which includes all the features of any other claim (dependent claim) shall contain, if possible at the beginning, a reference to the other claim and then state the additional features. A dependent claim directly referring to another dependent claim shall also be admissible. All dependent claims referring back to a single previous claim, and all dependent claims referring back to several previous claims, shall be grouped together to the extent and in the most appropriate way possible. 
(5) The number of claims shall be reasonable with regard to the nature of the invention claimed. The claims shall be numbered consecutively in Arabic numerals. 
(6) Except where absolutely necessary, claims shall not rely on references to the description or drawings in specifying the technical features of the invention. In particular, they shall not contain such expressions as "as described in part ... of the description", or "as illustrated in figure ... of the drawings". 
(7) Where the European patent application contains drawings including reference signs, the technical features specified in the claims shall preferably be followed by such reference signs relating to these features, placed in parentheses, if the intelligibility of the claim can thereby be increased. These reference signs shall not be construed as limiting the claim. 


Article 52
Patentable inventions

(1) European patents shall be granted for any inventions, in all fields of technology, provided that they are new, involve an inventive step and are susceptible of industrial application. 
(2) The following in particular shall not be regarded as inventions within the meaning ofparagraph 1:
(a) discoveries, scientific theories and mathematical methods; 
(b) aesthetic creations; 
(c) schemes, rules and methods for performing mental acts, playing games or doing business, and programs for computers;

Article 54
Novelty

(1) An invention shall be considered to be new if it does not form part of the state of the art. 
(2) The state of the art shall be held to comprise everything made available to the public by means of a written or oral description, by use, or in any other way, before the date of filing of the European patent application. 
(3) Additionally, the content of European patent applications as filed, the dates of filing of which are prior to the date referred to in paragraph 2 and which were published on or after that date, shall be considered as comprised in the state of the art.
(4) Paragraphs 2 and 3 shall not exclude the patentability of any substance or composition, comprised in the state of the art, for use in a method referred to in Article 53(c), provided that its use for any such method is not comprised in the state of the art.
(5) Paragraphs 2 and 3 shall also not exclude the patentability of any substance or composition referred to in paragraph 4 for any specific use in a method referred to in Article 53(c), provided that such use is not comprised in the state of the art.

The motivation of ford is great that the customer buys a car that gives a self-propelled unicycle as an additional gift. When it is not convenient for parking the car in specific location as crowd, the lord of the car can remove a single wheel from the car and use the single wheel as self-propelled unicycle to ride.
However, the customer may buy a car and a self-propelled unicycle. The customer puts the self-propelled unicycle into the trunk of the car. It is more convenient without removing the single wheel from the car and assembling the self-propelled unicycle.

Powered single-wheeled self-balancing vehicle for standing user

A powered, gyroscopically balanced unicycle device to be used while standing, having leg contact surfaces which are made of a yielding, slightly soft material whose mild friction against the user's legs allows stable, precise control of the device without restraining the legs in any way. In one embodiment a single hubless wheel is driven by a friction drive mechanism which transmits torque from a motor through a drive wheel positioned below the foot platforms and in contact with the inner rim of the wheel. Various structures are provided for supporting the wheel and keeping it in place as it spins; absorbing small vertical movements of the wheel to prevent them from being transmitted to the foot platforms; enabling folding of the foot platforms; and facilitating carrying of the device by hand. The motivation is great that the teacher and students invent a self-locking window lock for high proportion of aging population.
