37 C.F.R. 1.219 EARLY PUBLICATION.
Applications that will be published under § 1.211 may be published earlier than as set forth in § 1.211(a) at the request of the applicant. Any request for early publication must be accompanied by the publication fee set forth in § 1.18(d). If the applicant does not submit a copy of the application in compliance with the Office electronic filing system requirements pursuant to § 1.215(c), the Office will publish the application as provided in § 1.215(a). No consideration will be given to requests for publication on a certain date, and such requests will be treated as a request for publication as soon as possible.
If an applicant wishes to have an application published earlier than the date that is eighteen months after the earliest filing date for which benefit is claimed, applicant may submit a request in compliance with 37 CFR 1.219 and the publication fee set forth in 37 CFR 1.18 (d). The Office will publish the application as soon as possible if the application is otherwise ready for publication. The publication process takes approximately 14 weeks and does not begin until the application is complete and ready for publication (e.g., an executed oath or declaration has been filed and the filing fee has been paid). See MPEP § 1120. The Office will not give any consideration to requests for publication on a certain date. Note that if early publication is requested, and the publication fee paid, applicant will not be required to pay the publication fee at allowance.

第三十六条  申请人撤回专利申请的,应当向国务院专利行政部门提出声明,写明发明创造的名称、申请号和申请日。撤回专利申请的声明在国务院专利行政部门作好公布专利申请文件的印刷准备工作后提出的,申请文件仍予公布;但是,撤回专利申请的声明应当在以后出版的专利公报上予以公告。

第四十六条

第四十六条  申请人请求早日公布其发明专利申请的,应当向国务院专利行政部门声明。国务院专利行政部门对该申请进行初步审查后,除予以驳回的外,应当立即将申请予以公布。

專利專責機關接到發明專利申請文件後,經審查認為無不合規定程式,且無應不予公開之情事者,自申請日後經過十八個月,應將該申請案公開之。
專利專責機關得因申請人之申請,提早公開其申請案。
發明專利申請案有下列情事之一,不予公開:
一、自申請日後十五個月內撤回者。
二、涉及國防機密或其他國家安全之機密者。
三、妨害公共秩序或善良風俗者。
第一項、前項期間之計算,如主張優先權者,以優先權日為準;主張二項
以上優先權時,以最早之優先權日為準。

Article 4 Requirements for Utility Model Registration
(1) A utility model may be granted for devices that are industrially applicable and relate to the shape or structure of an article or a combination of articles, unless they fall under either of the following subparagraphs:
(i) devices publicly known or worked in the Republic of Korea or a foreign country before the filing of the utility model application; or
(ii) devices described in a publication distributed in the Republic of Korea or in a foreign country before the filing of the utility model application or made available to the public through electronic telecommunication lines under Presidential Decree.
(2) Notwithstanding paragraph(1), where a device could easily have been made before the filing of the utility model application by a person with ordinary skill in the art to which the device pertains, on the basis of a device referred to in either subparagraph of paragraph (1), a utility model registration may not be granted to that device.
(3) Notwithstanding paragraph (1), where a device for which a utility model application is filed is identical to a device or an invention described in the description or drawing(s) originally attached to another utility model application or a patent application, and where the other utility model application was filed before the utility model application and published after registration for public inspection after the filing date of the utility model application, or where a patent application was filed before the utility model application and laid open or published after grant for public inspection after the filing date of the utility model application, a utility model may not be granted for the device of the utility model application. This provision does not apply, however, where the 6 inventor of the utility model application and the inventor of the other utility model or patent application are the same person or where the applicant of the utility model application and the applicant of the other utility model or patent application are the same person at the time of filing.
(4) In applying paragraph (3), where the other utility model or patent application falls under one of the following subparagraphs, “laid open” of paragraph 3 reads “laid open or was the subject of an international publication under Article 21 of the Patent Cooperation Treaty”, and "a device or invention described in the description or drawing(s) originally attached" reads, in case the application was filed in Korean, "a device or invention described in the description, claim(s) or drawing(s) of the international application as of the international filing date" and, in case the application was filed in a foreign language, “a device or an invention described in the description, claim(s) or drawing(s) described both in the international application as of the international filing date and its translated version”:
(i) the other utility model application is an international application (including an international application that is deemed a utility model application according to Article 40(4)) that is deemed a utility model application according to Article 34(1); and
(ii) the patent application is an international application that is deemed a patent application according to Article 199(1) of the Patent Act (including an international application that is deemed a patent application according to Article 214(4) of the Patent Act).
  
Article 8 Application for a Utility Model Registration
(1) A person seeking to register a utility model shall file a utility model application with the Commissioner of the Korean Intellectual Property Office, stating the following:
(i) the name and address of the applicant (and, if a legal entity, the name and address of the business);
(ii) the name and residential or business address of an agent, if any (and, if the agent is a patent legal entity, the name and address of the business and the name of the designated patent attorney);
(iii) the title of the device; and (iv) the name and address of the deviser;
(2) A utility model application under paragraph (1) must be accompanied by an abstract, drawing(s) and a description stating the following:
(i) the title of the device;
(ii) a brief explanation of the drawing(s);
(iii) a detailed description of the device; and (iv) the claim(s).
(3) In a method prescribed by ordinance of the Ministry of Commerce, Industry and Energy, the detailed description of a device under paragraph (2)(iii) of this Article must be clear and detailed enough to enable a person with ordinary skill in the art to which the device pertains to work the device easily.
(4) The claim(s) under paragraph (2)(iv) must describe the matter for which protection is sought 10 in one or more claims (referred to as "claim(s)"), and the claim(s) must comply with each of the following subparagraphs:
(i) the claim(s) must be supported by a detailed description of the device;
(ii) the claim(s) must define the device clearly and concisely 
(iii) deleted.
(5) Notwithstanding paragraph (2) of this Article, when a person files an application to register a utility model, the description that must be submitted with the application may exclude the scope of claims claim(s) referred to in paragraph (2)(iv). In this case, however, the person shall amend the description to include the scope of claim(s) not later than the relevant deadline stipulated in either of the following subparagraphs:
(i) the date on which a period of one year and six months elapses after the date that falls under any of the subparagraphs of Article 64(1) of the Patent Act, which applies mutatis mutandis under Article 15 of this Act; or
(ii) the date on which a period of three months elapses after the date on which a notice of the purport of a request to examine an application is given under Article 60(3) of the Patent Act, which applies mutatis mutandis under Article 15 of this Act, before the deadline stipulated in subparagraph (i) of this paragraph (provided the notice is given more than one year and three months after the date that falls under any of the subparagraphs of Article 64(1) of the Patent Act, which applies mutatis mutandis under Article 15 of this Act).
(6) In stating the scope of claims for utility model registration under paragraph (2)(iv) of this Article, the applicant shall specify the shape and structure or a combination of these for the purpose of clarifying which specific parts of the design are be protected.
(7) Where a person who has applied to register a utility model fails to amend the description that does not contain the scope of claim(s) by the relevant deadline stipulated in the subparagrpahs of paragraph (5) of this Article, the application for utility model registration is deemed to have been withdrawn on the date immediately following the relevant deadline.
(8) Necessary matters related to the method of stating the scope of claims for utility model registration under subparagraph (2)(iv) of this Article are prescribed by Presidential Decree.

(9) Necessary matters related to the method of preparing an abstract under paragraph(2) of this Article are prescribed by ordinance of the Ministry of Commerce, Industry and Energy.

Patentable inventions
1.-(1) A patent may be granted only for an invention in respect of which the following conditions are satisfied, that is to say -
(a) the invention is new;
(b) it involves an inventive step;
(c) it is capable of industrial application;
(d) the grant of a patent for it is not excluded by subsections (2) and (3) or section 4A below;
and references in this Act to a patentable invention shall be construed accordingly.
(2) It is hereby declared that the following (among other things) are not inventions for the purposes of this Act, that is to say, anything which consists of -
(a) a discovery, scientific theory or mathematical method;
(b) a literary, dramatic, musical or artistic work or any other aesthetic creation whatsoever;
(c) a scheme, rule or method for performing a mental act, playing a game or doing business, or a program for a computer;
(d) the presentation of information;
but the foregoing provision shall prevent anything from being treated as an invention for the purposes of this Act only to the extent that a patent or application for a patent relates to that thing as such.
(3) A patent shall not be granted for an invention the commercial exploitation of which would be contrary to public policy or morality.
(4) For the purposes of subsection (3) above exploitation shall not be regarded as contrary to public policy or morality only because it is prohibited by any law in force in the United Kingdom or any part of it.
(5) The Secretary of State may by order vary the provisions of subsection (2) above for the purpose of maintaining them in conformity with developments in science and technology; and no such order shall be made unless a draft of the order has been laid before, and approved by resolution of, each House of Parliament.



Making of application
14.-(1) Every application for a patent -
(a) shall be made in the prescribed form and shall be filed at the Patent Office in the prescribed manner;
(b) [repealed]
(1A) Where an application for a patent is made, the fee prescribed for the purposes of this subsection (“the application fee”) shall be paid not later than the end of the period prescribed for the purposes of section 15(10)(c) below.
(2) Every application for a patent shall contain -
(a) a request for the grant of a patent;
(b) a specification containing a description of the invention, a claim or claims and any drawing referred to in the description or any claim; and
(c) an abstract;
but the foregoing provision shall not prevent an application being initiated by documents complying with section 15(1) below.
(3) The specification of an application shall disclose the invention in a manner which is clear enough and complete enough for the invention to be performed by a person skilled in the art.
(4) [repealed]
(5) The claim or claims shall -
(a) define the matter for which the applicant seeks protection;
(b) be clear and concise;
(c) be supported by the description; and
(d) relate to one invention or to a group of inventions which are so linked as to form a single inventive concept.
(6) Without prejudice to the generality of subsection (5)(d) above, rules may provide for treating two or more inventions as being so linked as to form a single inventive concept for the purposes of this Act.
(7) The purpose of the abstract is to give technical information and on publication it shall not form part of the state of the art by virtue of section 2(3) above, and the comptroller may determine whether the abstract adequately fulfils its purpose and, if it does not, may reframe it so that it does.
(8) [repealed]
(9) An application for a patent may be withdrawn at any time before the patent is granted and any withdrawal of such an application may not be revoked.
(10) Subsection (9) above does not affect the power of the comptroller under section 117(1) below to correct an error or mistake in a withdrawal of an application for a patent.

Rule 43
Form and content of claims

(1) The claims shall define the matter for which protection is sought in terms of the technical features of the invention. Wherever appropriate, claims shall contain: 
(a) a statement indicating the designation of the subject-matter of the invention and those technical features which are necessary for the definition of the claimed subject-matter but which, in combination, form part of the prior art; 
(b) a characterising portion, beginning with the expression "characterised in that" or "characterised by" and specifying the technical features for which, in combination with the features stated under sub-paragraph (a), protection is sought.
(2) Without prejudice to Article 82, a European patent application may contain more than one independent claim in the same category (product, process, apparatus or use) only if the subject-matter of the application involves one of the following:
(a) a plurality of interrelated products, 
(b) different uses of a product or apparatus, 
(c) alternative solutions to a particular problem, where it is inappropriate to cover these alternatives by a single claim. 
(3) Any claim stating the essential features of an invention may be followed by one or more claims concerning particular embodiments of that invention. 
(4) Any claim which includes all the features of any other claim (dependent claim) shall contain, if possible at the beginning, a reference to the other claim and then state the additional features. A dependent claim directly referring to another dependent claim shall also be admissible. All dependent claims referring back to a single previous claim, and all dependent claims referring back to several previous claims, shall be grouped together to the extent and in the most appropriate way possible. 
(5) The number of claims shall be reasonable with regard to the nature of the invention claimed. The claims shall be numbered consecutively in Arabic numerals. 
(6) Except where absolutely necessary, claims shall not rely on references to the description or drawings in specifying the technical features of the invention. In particular, they shall not contain such expressions as "as described in part ... of the description", or "as illustrated in figure ... of the drawings". 
(7) Where the European patent application contains drawings including reference signs, the technical features specified in the claims shall preferably be followed by such reference signs relating to these features, placed in parentheses, if the intelligibility of the claim can thereby be increased. These reference signs shall not be construed as limiting the claim. 


Article 52
Patentable inventions

(1) European patents shall be granted for any inventions, in all fields of technology, provided that they are new, involve an inventive step and are susceptible of industrial application. 
(2) The following in particular shall not be regarded as inventions within the meaning ofparagraph 1:
(a) discoveries, scientific theories and mathematical methods; 
(b) aesthetic creations; 
(c) schemes, rules and methods for performing mental acts, playing games or doing business, and programs for computers; 
(d) presentations of information. 
(3) Paragraph 2 shall exclude the patentability of the subject-matter or activities referred to therein only to the extent to which a European patent application or European patent relates to such subject-matter or activities as such. 


Article 54
Novelty

(1) An invention shall be considered to be new if it does not form part of the state of the art. 
(2) The state of the art shall be held to comprise everything made available to the public by means of a written or oral description, by use, or in any other way, before the date of filing of the European patent application. 
(3) Additionally, the content of European patent applications as filed, the dates of filing of which are prior to the date referred to in paragraph 2 and which were published on or after that date, shall be considered as comprised in the state of the art.
(4) Paragraphs 2 and 3 shall not exclude the patentability of any substance or composition, comprised in the state of the art, for use in a method referred to in Article 53(c), provided that its use for any such method is not comprised in the state of the art.
(5) Paragraphs 2 and 3 shall also not exclude the patentability of any substance or composition referred to in paragraph 4 for any specific use in a method referred to in Article 53(c), provided that such use is not comprised in the state of the art.


Article 84
Claims

The claims shall define the matter for which protection is sought. They shall be clear and concise and be supported by the description.

ADVISORY ACTIONS

706.07(F)   TIME FOR REPLY TO FINAL REJECTION

The time for reply to a final rejection is as follows:
  • (A) All final rejections setting a 3-month shortened statutory period (SSP) for reply should contain one of form paragraphs 7.39, 7.40, 7.40.01, 7.40.02.fti, 7.40.02.aia, 7.41, 7.41.03, 7.42.03.fti, 7.42.031.fti, or 7.42.09 advising applicant that if the first reply is filed within 2 months of the date of the final Office action, the shortened statutory period will expire at 3 months from the date of the final rejection or on the date the advisory action is mailed, whichever is later. Thus, a variable reply period will be established. If the last day of “2 months of the date of the final Office action” falls on Saturday, Sunday, or a Federal holiday within the District of Columbia, and a reply is filed on the next succeeding day which is not a Saturday, Sunday, or a Federal holiday, pursuant to 37 CFR 1.7(a), the reply is deemed to have been filed within the 2 months period and the shortened statutory period will expire at 3 months from the date of the final rejection or on the mailing date of the advisory action, whichever is later (see MPEP § 710.05). In no event can the statutory period for reply expire later than 6 months from the mailing date of the final rejection.
  • (B) This procedure of setting a variable reply period in the final rejection dependent on when applicant files a first reply to a final Office action does not apply to situations where a SSP less than 3 months is set, e.g., reissue litigation applications (1-month SSP) or any reexamination proceeding.

I.   ADVISORY ACTIONS

  • (C) Where the final Office action sets a variable reply period as set forth in paragraph (A) above AND applicant files a complete first reply to the final Office action within 2 months of the date of the final Office action, the examiner must determine if the reply:
    • (1) places the application in condition for allowance — then the application should be processed as an allowance and no extension fees are due;
    • (2) places the application in condition for allowance except for matters of form which the examiner can change without authorization from applicant, MPEP § 1302.04 — then the application should be amended as required and processed as an allowance and no extension fees are due; or
    • (3) does not place the application in condition for allowance — then the advisory action should inform applicant that the SSP for reply expires 3 months from the date of the final rejection or as of the mailing date of the advisory action, whichever is later, by checking box 1.b) at the top portion of the Advisory Action form, PTOL-303.
  • (D) Where the final Office action sets a variable reply period as set forth in paragraph (A) above, and applicant does NOT file a complete first reply to the final Office action within 2 months, examiners should check box 1.a) at the top portion of the Advisory Action form, PTOL-303.
  • (E) When box 1.b) at the top portion of the Advisory Action form, PTOL-303 is checked, the time for applicant to take further action (including the calculation of extension fees under 37 CFR 1.136(a)) begins to run 3 months from the date of the final rejection, or from the date of the advisory action, whichever is later. Extension fees cannot be prorated for portions of a month. In no event can the statutory period for reply expire later than 6 months from the date of the final rejection. For example, if applicant initially replies within 2 months from the date of mailing of a final rejection and the examiner mails an advisory action before the end of 3 months from the date of mailing of the final rejection, the shortened statutory period will expire at the end of 3 months from the date of mailing of the final rejection. In such case, if a petition for extension of time is granted, the due date for a reply is computed from the date stamped or printed on the Office action with the final rejection. See MPEP § 710.01(a). If the examiner, however, does not mail an advisory action until after the end of the 3-month period, the shortened statutory period will expire on the date the examiner mails the advisory action and any extension of time fee would be calculated from the mailing date of the advisory action.

三讀修正通過勞動基準法部分條文

事:修正通過勞動基準法部分條文,明訂離職員工競業禁止條款。競業禁止期間最長不得逾2年,且雇主對勞工因不從事競業行為所受損失應有合理補償。

物:三讀條文將競業條款相關規範明訂在勞動基準法中,規定雇主須與勞工以書面方式約定競業禁止,禁止年不得超過2年,還須符合4點規範,否則該競業條款無效。
三讀條文規定,雇主調動勞工工作,不得有不當動機及目的,對工資及其他勞動條件不能不利變更;若調動工作地點過遠,雇主應給予必要協助,並需考量勞工家庭的生活利益。
摘要:

勞動部過去考量鉅額違約金規定員工不得跳槽是影響就業權,參考多年法院判決,增訂「勞資雙方簽訂離職後競業禁止條款參考原則」,讓業界及法院有遵循原則。4點規範包括雇主要有受保護的正當營業利益、勞工職能接觸營業祕密法中定義的營業祕密。競業禁止條例禁止的期間、區域、職業活動範圍、就業對象不得超過合理範圍,且對於勞工不從事競業行為所受損失應有合理補償。
三讀條文也明訂,所謂「合理補償」不包括勞工在工作期間受領的給付。離職前發給的紅利、年終獎金、工資都不得折抵。
