Yeh1978: cycle safety seat

此Hsu揭露了一種cycle safety seat(腳踏車用安全座椅)，包括seat body 40、seat portion 41、joint portion 71、fixing portion 81、pivoted portion 74 with a hinge 92、quick release mechanism82~84、retractable handle 36、wheeled assembly 56,62以及means for adjusting an oblique angle of the seat portion。簡單來說，Hsu已公開安全座椅、乘坐部、接合部、固定部及樞轉部等技術特徵。
技術特徵為：
(1) Hsu2的pivoted portion 74係用以調整椅背的傾斜角度，以及fixing portion 81係用以連接至腳踏車的後座，並不同於「安全座椅以該樞轉部為轉動軸心，以該樞轉部為轉動軸心，使該安全座椅自機車前端向後端的方向來轉動」之技術特徵。
(2) Hsu2的pivoted portion 74係用以調整椅背的傾斜角度，並不同於「樞轉部為旋轉鋼軸組件或鉸鏈」之技術特徵。
關於區別(1)：
根據Hsu之圖6、圖7及說明書第8欄第16~41行所述內容可知，” Please refer to FIG. 6. To assembly the present invention onto a rear carrier A of a bicycle, the ribs 812 of said mounting body 81 thereof are led through the slide guide way 811 of said wheel pivot seat 74 and engaged with the inserting part 7451 thereof. Said pin blocks 82 led through said connecting holes 8161 will be relocated at said inserting blocks 816 therein to secure said wheel pivot seat 74 onto said mounting seat 80 thereof. Said mounting seat 80 engaged with said wheel pivot seat 74 thereof is then adapted to said rear carrier A thereof. Said triangular pieces 86 and wing panel 87 are applied from the underside of said mounting body 81 to fixedly secure said mounting seat 80 thereof onto said rear carrier A of a bicycle as shown in FIG. 6.” 。簡單來說，Hsu之安全座椅係可拆地裝設於腳踏車的後坐，且安全座椅亦可收起或展開其車輪組件，以使安全座椅可作為嬰兒推車使用。
然而，Hsu並未揭露「樞轉部樞接於該安全座椅與該固定部，該安全座椅以該樞轉部為轉動軸心，使該安全座椅自機車前端向後端的方向來轉動」之技術特徵。其中，為方便開啟機車或摩托車的置物箱，因此，安全座椅透過樞接部以及快拆元件，以使安全座椅以該樞轉部為轉動軸心，使該安全座椅自機車前端向後端的方向來轉動，藉此使用者可掀起機車坐墊。
關於區別(2)：
根據Hsu之圖5及說明書第7欄第32~50行所述內容可知，”The strengthening plate 63 is fastened to said rear-wheel bracket 62 via screws 91.
